Vendor Rate Adjustments for Employee Sick LeaveDue to the enactment of assemble bill 1522 (AB 1522), effective July 1, 2015 employees who work on or after July 1, 2015 and work 30 or more days within a year are entitled to accrue sick leave at a rate of one hour for every 30 hours worked. Proposed trailer bill language will allow the Department of Developmental Services (DDC) or the local regional center (HRC), depending on the type of vendor, to process rate adjustments for affected vendors.Service Providers affected by the requirements of AB 1522 with rates established in the following ways may be eligible for a rate adjustment:
Rate Set by DDS – Community-Based Day Programs, Work Activity Programs or In-Home Respite Agencies
Service providers classified as day programs, inclusion infant programs (service code 805), adult day programs (5505, 510, 515), independent living services (520), and providers classified as Work Activity Programs (service code 954) and In-home Respite Agencies (service code 862) may submit a rate adjustment to DDS by completing a workbook linked below. Cost and program information being requested shall only include the costs necessary to fund a maximum of 24 hours or three paid sick days to applicable employees, and the units of service billed to the regional center for the period of January 1, 2015 through March 31, 2015. Any approved rate adjustment will be effective July 1, 2015. Rates set by Regional Centers through Negotiation
For service providers with negotiated rates vendored through Harbor Regional Center, HRC is requesting that you complete the AB 1522 Employee Sick Leave Workbook only if your negotiated rate was established without allotment/allocation of sick leave benefit for employees that meets the requirements of AB 1522. Otherwise if you are already providing the sick leave benefit at or above the level required b AB 1522, you should not complete the workbook.
Rates Set by the Alternative Residential Model (ARM) Rates
Service providers Reimbursed under the ARM rates (residential provider service code 905, 910, 915, & 920), the new ARM rates can be found at htt://www.dds.com.gov/rates/docs/ccf_rate_july2015.pdf ). Providers with ARM rates do not need to submit rate adjustment requests.

Minimum Wage Increase
The following has been announced by The California Department of Developmental Services: Rate Changes due to the Minimum Wage Increase, July 1, 2014
Due to the passage of AB 10, minimum wage in California will increase from $8.00 to $9.00 per hour, effective July 1, 2014. Regional center vendors that are affected by this change may be eligible to receive a rate adjustment in order to pay employees the new minimum wage. This page contains information for applicable vendors on submitting rate adjustment requests to the Department.
WHO MAY QUALIFY?
The process for requesting a rate adjustment described on this page is only applicable to the following types of services: Work Activity Programs and Community-Based Day Programs (e.g. Activity Centers, Adult Development Centers, Behavior Management Programs Independent Living Programs, Social Recreation Programs, and Infant Development Programs).
Providers of other types of services should review the page linked below for more information on rate adjustments due to the increased minimum wage.
BEFORE YOU BEGIN:
If you are a provider of the services identified above and you answer "Yes" to both questions below, this process applies to your program. If you answer “No” to one or both questions, visit the Rate Changes Due to the Minimum Wage Increase webpage for more information.
Is your program vendored by a regional center to provide services under service codes 505, 510, 515, 520, 525, 805, and/or 954?
Did you pay or are you paying employees less than $9.00 per hour?
DEFINITION OF A PROGRAM:
For purposes of this process, a program is a single regional center vendor number and service code combination. Therefore, the information you provide must be separated for each program under the specific vendor number and service code combination.
INSTRUCTIONS AND WORKBOOK:
The 2014 Minimum Wage Rate Adjustment workbook posted on the DDS webpage should be used by applicable providers to submit rate adjustment requests to the Department. Detailed instructions are contained in the tabs that precede the worksheets. Vendors can begin submitting rate adjustment requests at any time but they must be submitted no later than September 2, 2014. Any rate adjustments approved will be effective July 1, 2014.
